This Privacy Policy is available in English and Spanish. In the event of any conflict or difference in interpretation between the two versions, the English version prevails.

This Privacy Policy explains how VAIONYX LLC, doing business as VAI IA ("VAIONYX," "VAI IA," "we," "us," or "our"), collects, uses, stores, discloses, and protects personal information when individuals and businesses use our websites, software platforms, artificial intelligence tools, dashboards, communications systems, integrations, and related services (collectively, the "Services").

By accessing or using the Services, you acknowledge the practices described in this Privacy Policy.

1. Scope of this Privacy Policy

This Privacy Policy applies to:

  • Business customers that create or manage a VAI IA account.
  • Authorized employees, administrators, and representatives of business customers.
  • Clients, customers, or contacts whose information is entered into VAI IA by a business customer.
  • Visitors to our website.
  • Individuals who communicate through email, SMS, forms, calendars, or AI-powered tools operated through VAI IA.

VAI IA is a business software platform. In some situations, VAIONYX LLC determines how personal information is used and acts as a data controller. In other situations, we process information on behalf of a business customer and act as a service provider or data processor.

When a business uses VAI IA to manage its own clients, appointments, or communications, that business is generally responsible for determining why the information is collected and ensuring that it has the necessary authority, consent, and legal basis to use it.

2. Information we collect

Depending on how the Services are used, we may collect the following categories of information.

2.1 Account and business information

We may collect:

  • Name.
  • Business name.
  • Email address.
  • Telephone number.
  • Job title or role.
  • Login credentials.
  • Account permissions.
  • Business address.
  • Business hours.
  • Services, prices, policies, and operational information.
  • Subscription and plan information.

Passwords are stored using security protections and are not intended to be stored in readable form.

2.2 Client, appointment, and customer information

Business customers may enter or connect information about their clients, including:

  • Client names.
  • Email addresses.
  • Telephone numbers.
  • Appointment dates and times.
  • Requested services.
  • Appointment status.
  • Notes and preferences.
  • Confirmation, cancellation, and rescheduling information.
  • Communication history.
  • Customer relationship information.

Business customers are responsible for ensuring that they are authorized to provide this information to VAI IA.

2.3 Conversations and artificial intelligence interactions

We may process:

  • Messages submitted to the VAI IA assistant.
  • Prompts and instructions.
  • Responses generated by artificial intelligence.
  • Actions requested through the assistant.
  • Pending confirmations.
  • Tool and automation results.
  • Conversation history.
  • Error and diagnostic information.

AI-generated responses may be inaccurate. Users should review important information and confirm actions before relying on an AI-generated response.

VAI IA may require user confirmation before performing certain actions, such as sending messages, modifying appointments, or changing business information.

2.4 SMS and email information

When communication features are enabled, we may process:

  • Sender and recipient telephone numbers.
  • Sender and recipient email addresses.
  • Message content.
  • Message identifiers.
  • Delivery status.
  • Timestamps.
  • Confirmation and cancellation responses.
  • Communications preferences.
  • Carrier or delivery error codes.

SMS and email messages may be processed through third-party communications providers.

Message and data rates may apply. Recipients may opt out of nonessential SMS communications by replying STOP or by contacting the business that sent the message. Replying HELP may provide assistance where supported.

VAI IA and its business customers are responsible for using messaging features only when appropriate consent or other lawful authorization has been obtained.

2.5 Calendar and integration data

If a user connects a calendar or third-party application, we may access information such as:

  • Calendar names.
  • Event titles.
  • Event dates and times.
  • Attendees.
  • Availability.
  • Event descriptions.
  • Appointment identifiers.
  • Authorization tokens.
  • Integration settings.

We use this information to provide requested features such as appointment synchronization, reminders, scheduling, confirmations, cancellations, and availability management.

Users may disconnect an integration through VAI IA or through the third-party provider when available.

2.6 Google user data

If a user connects a Google account or Google Calendar, VAI IA may access only the Google user data and permissions necessary to provide the requested functionality.

Our use of information received from Google APIs will comply with the Google API Services User Data Policy, including applicable Limited Use requirements.

Google user data will not be:

  • Sold to data brokers.
  • Used for targeted advertising.
  • Used to determine creditworthiness.
  • Transferred to unrelated third parties except as necessary to provide the requested feature, maintain security, comply with law, or complete a business transaction with appropriate protections.

We request only permissions that are reasonably necessary for the features the user chooses to enable.

2.7 Payment and billing information

When payment features are enabled, we may collect:

  • Billing name and address.
  • Subscription plan.
  • Payment status.
  • Invoice information.
  • Transaction identifiers.
  • Renewal and cancellation status.
  • Limited payment method details, such as card type and last four digits.

Full payment card details are expected to be processed by an authorized third-party payment processor. VAIONYX LLC does not intend to directly store full card numbers or card security codes.

The payment processor may process information under its own privacy policy and legal obligations.

2.8 Cookies, device data, and analytics

We may automatically collect:

4. Artificial intelligence processing

Information submitted to AI features may be processed by third-party AI infrastructure providers that help operate the Services.

We seek to limit information shared with these providers to what is reasonably necessary to provide the requested functionality.

Users should not submit highly sensitive information to AI features unless it is necessary, legally permitted, and authorized by the affected individual.

VAI IA does not use artificial intelligence to make final decisions that produce legal or similarly significant effects concerning an individual without appropriate human involvement.

Business customers remain responsible for reviewing AI-generated content before using it in important business decisions or customer communications.

5. How we share information

We may share information with the following categories of recipients.

We may use service providers for:

  • Artificial intelligence processing.

These providers may process information only as reasonably necessary to provide their services to us, subject to their contractual and legal obligations.

VAIONYX LLC is not responsible for how a business customer independently uses information outside the VAI IA platform.

5.3 Legal and safety disclosures

6. No sale of personal information

VAIONYX LLC does not sell personal information for monetary consideration.

We do not share personal information for cross-context behavioral advertising or targeted advertising as those terms are defined under applicable privacy laws.

If these practices change, we will update this Privacy Policy and provide any legally required notices and opt-out mechanisms before implementing the change.

7. Data security

We use reasonable administrative, technical, and organizational measures designed to protect personal information.

These measures may include:

  • Encryption of selected integration credentials at rest.

Depending on where an individual lives and which laws apply, the individual may have the right to:

Because VAI IA often processes information on behalf of a business customer, an individual may need to submit a request directly to the business that collected the information.

Authorized agents may submit requests where permitted, subject to verification.

We will not unlawfully discriminate against an individual for exercising a privacy right.

10. Communication preferences

Users may unsubscribe from marketing emails using the unsubscribe link included in the message.

Recipients may opt out of eligible SMS messages by replying STOP.

Opting out of marketing communications does not necessarily prevent transactional or service-related communications, such as:

  • Security notices.
  • Account updates.
  • Payment notices.
  • Appointment communications requested by the user.
  • Legally required notices.

Users may also contact us or the applicable business customer to update communication preferences.

11. Cookies and tracking choices

Browsers may allow users to block or delete cookies.

Disabling essential cookies may prevent login, account security, preferences, or other core platform features from functioning properly.

Where legally required, we will obtain consent before using nonessential cookies or similar technologies.

VAI IA does not currently respond to every browser-based "Do Not Track" signal because there is no universally accepted technical standard. We will honor legally recognized opt-out preference signals where required and technically supported.

12. International data transfers

VAIONYX LLC is based in the United States.

Information may be processed in the United States or other locations where our service providers operate.

These locations may have data protection laws different from those in the user's country.

Where required, we will use appropriate contractual, legal, or organizational safeguards for international transfers.

13. Children's privacy

The Services are designed for businesses and are not directed to children under 13 years of age.

We do not knowingly collect personal information directly from children under 13 without appropriate parental authorization.

If we learn that information was collected from a child in violation of applicable law, we will take reasonable steps to delete it.

15. Business customer responsibilities

Business customers using VAI IA agree that they are responsible for:

  • Providing required privacy notices to their clients.
  • Obtaining appropriate consent for email, SMS, calendar, and AI processing.
  • Using personal information only for lawful purposes.
  • Maintaining accurate client information.
  • Restricting platform access to authorized users.
  • Responding to client privacy requests when they control the information.
  • Avoiding the entry of unnecessary sensitive information.
  • Complying with applicable communications and privacy laws.

VAIONYX LLC may suspend or restrict use of the Services when we reasonably believe the platform is being used unlawfully or in a manner that creates security, privacy, or safety risks.

16. Changes to this Privacy Policy

We may update this Privacy Policy as VAI IA evolves or as legal requirements change.

When material changes are made, we may provide notice through:

  • The application.
  • Email.
  • The account dashboard.

The updated version will show a revised "Last updated" date.
